About Kant Enclave Faridabad

The development of Kant Enclave dates back to around 1980, when the promoter obtained a licence from the Government of Haryana for the development of a township spread over approximately 425 acres of land.

The proposed development included Kant Enclave (Allied Complex and Film Studio), along with five Group Housing projects, while the remaining area was planned for residential development.

Over the years, the area witnessed substantial development and a significant number of transactions involving plots and land. In 1992, provisions relating to the Punjab Land Preservation Act (PLPA) became applicable, leading to various regulatory and legal complexities concerning the land and development activities in the area.

Subsequently, several matters relating to the land, ownership, construction and development of the area came before various judicial forums. During this period, some property transactions and registrations took place, while at a later stage, the registration of properties was stopped/restricted. A number of purchasers had already constructed residential houses on their respective properties, while other properties had changed hands through transactions undertaken at different points in time.

Current Status

At present, various matters concerning Kant Enclave continue to be examined at the judicial and administrative levels. Discussions and processes relating to the future of the area, land status and diversification/land-use diversification are also being pursued at the State Government level.

The ongoing diversification process is expected to provide a structured framework for addressing the various land-use and development-related issues associated with the area, subject to the applicable laws, regulations and decisions of the competent authorities.

Environmental & Land-Use Issues

This date became significant in the later Supreme Court proceedings concerning construction and restrictions applicable to the area.

11 September 2018 — Supreme Court Judgment
